Pilot Judgment Inc. is an online service that measures judgment through the Pilot Judgment® Assessment, and then helps individuals and teams improve their judgment through the Pilot Judgment® Program.

Should you join Pilot Judgment®, you agree to be bound by  these Terms and Conditions for use of the Pilot Judgment Inc. Program (the “Program”), and you acknowledge your assent to these Terms and Conditions without limitation or qualification. These Terms and Conditions may be modified, revised, or amended at anytime.

DISCLAIMER

To the fullest extent permissible by law, the Program and all content, materials, information, software, graphics, videos, and reports are provided “as is” and without warranties of any kind, express or implied, including but not limited to, implied warranties of merchantability or fitness for a particular purpose. Pilot Judgment Inc. and its subsidiaries, affiliates, officers, or directors (collectively “Pilot Judgment®”) does not warrant that the information contained in the Program, or any reports, ratings, scores, or evaluations generated from your use thereof, will be uninterrupted or error free.

Any reports, ratings, scores, or evaluations generated by Pilot Judgment® or otherwise related to your use of the Program, and all videos, graphics or demonstrations contained within the Program, are solely for educational and training purposes. Pilot Judgment® does not warrant or make any representations regarding your use of the Program or the results of that use.

The Program is intended solely to provide a means of assessing and quantifying your judgment and to provide educational materials for the purpose of improving your judgment. Pilot Judgment® does not warrant or make any representations regarding your actual qualification, skill, training, or ability to perform as a pilot or any other activity. Pilot Judgment® does not provide, and shall not be interpreted by you or any other party as providing, any instructions or training in any field, including but not limited to aviation.

LIMITATION OF LIABILITY

Pilot Judgment® assumes no responsibility, and shall not be liable for, any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to, damages for loss of profits, revenue, data or use, property damages, or bodily injury, whether incurred by you or any third party, arising from or related to your use of the Program.

INDEMNIFICATION

Should you join Pilot Judgment®, you agree to indemnify, defend, and hold harmless Pilot Judgment Inc., its officers, directors, affiliates, subsidiaries, employees, and agents, from and against any and all claims, actions, demands, losses, expenses (including attorney’s fees), damages, penalties, judgments, and costs arising from or in any way connected to your use of the Program.

RESTRICTIONS ON USE

The Program is owned and operated by Pilot Judgment®.  Except as otherwise permitted by Pilot Judgment®, no information or materials from the Program may by copied, reproduced, republished, uploaded, posted, transmitted, or distributed in any way.  You may use the materials in the Program for your use only, provided that you also retain all copyright and other proprietary notices contained in the materials.  You shall not distribute, modify, transmit, reuse, repost, or use any content of the Program, or content which is otherwise owned and operated by Pilot Judgment®, for public or commercial purposes, including text, audio, and video, without Pilot Judgment’s written permission.  Pilot Judgment® neither warrants nor represents that your use of materials displayed in the Program will not infringe rights of third parties.

TRADEMARKS AND COPYRIGHTS

All trademarks, service marks, trade names, logos, and icons are proprietary to Pilot Judgment®. Nothing contained in the Program should be construed as granting, by implication, estoppel, or otherwise, any license or right to use any trademarks, service marks, trade names, logos, and icons without the express written consent of Pilot Judgment®. Your use of the trademarks, service marks, trade names, logos, and icons of the Program, except as provided herein, is expressly prohibited.

The content and images displayed in the Program, including all text, audio, and video, either is the property of, or used with permission by, Pilot Judgment®. The use of this content or these images by you is expressly prohibited. By accepting these Terms and Conditions, you further agree not to infringe upon any proprietary rights of Pilot Judgment™ or decompile, reverse engineer, or disassemble any portion of the Program. Any unauthorized use of the Program may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications, regulations, and statutes.
